Ebbrate

Terms of Use

The rules for sellers who post shipments and carriers who bid on them. By creating an account or using Ebbrate, you accept them.

1. Who we are

Ebbrate is operated by Sellernova Limited, a company registered in the Republic of Cyprus (“we”, “us”). You can reach us at admin@ebbrate.com.

2. What Ebbrate is, and is not

Ebbrate is a marketplace. Sellers post shipments, and carriers and freight forwarders bid to move them.

We are not a carrier, freight forwarder, customs broker or insurer, and we do not move goods. When a seller accepts a bid, the contract of carriage is between the seller and that carrier, on the terms of the bid and of these Terms.

3. Your account

Accounts are for businesses and for people acting for a business, aged 18 or over. You must give accurate details and keep them current.

Keep your password to yourself. You are responsible for what is done from your account, including by members of your team you have invited.

4. Verification and screening

We ask sellers and carriers for documents that show who they are, and ask carriers for their licences and insurance. A carrier can see shipments before it is verified but cannot bid until it is. Verification expires and has to be renewed with current documents.

We screen accounts and the parties to shipments against sanctions and export-control lists, and may refuse, pause or close an account that fails screening.

Verification means we checked the documents we were given. It is not a guarantee of a carrier’s performance.

5. Shipments, bids and awards

A seller describes the cargo, route and dates. That description must be accurate: carriers price on it.

A carrier’s bid is an offer to carry the shipment as described, at that price. A carrier can withdraw a bid, but withdrawing one that has been accepted counts against its score, which sellers see.

A seller is free to accept any bid or none. Accepting a bid awards the shipment to that carrier and creates the contract of carriage between them.

After an award, the seller must hand over the pickup and delivery contacts by the deadline shown. If it does not, we may cancel the award.

6. Fees and payouts

Ebbrate is free for sellers. Carriers pay a fee: a percentage of the service part of the price they are paid, never of duties and taxes they only advance. The rate that applies is shown in the carrier’s account before it bids.

A carrier’s payout is released after delivery, once the claim window has closed without a claim, or once a claim has been settled. The date is shown on each shipment.

7. Cargo, documents and customs

The seller is responsible for the goods being lawful to export and import, for accurate commercial documents, and for the customs arrangements it chooses on the shipment, including who acts as importer of record.

You may not use Ebbrate to ship goods that are prohibited or restricted on the route without the licences they need, or to deal with anyone on a sanctions list.

8. Claims

A seller can file a claim about damage, loss, missing units or a loss caused by late delivery within 14 days of delivery. While a claim is open, the carrier’s payout for that shipment is held.

The carrier has 7 days to respond. A claim the carrier does not answer is resolved in the seller’s favour.

We may review a claim and decide what happens to a held payout. That decision settles the payout on Ebbrate; it does not stop either side from pursuing its rights under the contract of carriage or the law.

9. How you use Ebbrate

You agree not to:

  • give false information, or bid on shipments you cannot carry;
  • post content that is unlawful, abusive or that you have no right to share;
  • access accounts or data that are not yours, or disrupt the service;
  • copy the site or its data by automated means.

10. Suspending and closing accounts

You can ask us to close your account at any time by writing to admin@ebbrate.com. An account with a shipment in transit, an open claim or money not yet settled is closed once those are finished.

We may pause or close an account that breaks these Terms, fails screening or puts other users at risk. Where we can, we tell you why.

11. Liability

We provide Ebbrate as it is. We work to keep it available and accurate but do not promise it will be uninterrupted or free of errors.

We are not liable for the carriage of goods, for what a seller or carrier does or fails to do, or for indirect losses such as lost profit or business. As far as the law allows, our total liability to you is limited to the fees you paid us in the 12 months before the claim.

Nothing in these Terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

12. Your data

How we handle personal data is set out in our Privacy Policy.

13. Law and disputes

These Terms are governed by the law of the Republic of Cyprus, and the courts of Cyprus have jurisdiction over disputes about them.

14. Changes to these Terms

We may change these Terms and will update the date at the top when we do. We tell you about significant changes by email before they apply. A shipment already awarded stays under the Terms in force when it was awarded.
